The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension triggered by the introduction of a new 28-article proposal for resolving the conflict appeared – briefly – to have been defused. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Rhythm of Diplomacy and Destruction

The sequence of opposing developments captured the harsh reality of the current period. By day, negotiation efforts are fought: hopeful statements are released from various governments. Significant resources is allocated on restraining specific proposals. By night, Russian leadership brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "settlement".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was revealed. Ukraine is equipped to monitor rocket firings from Russian territory, a ability enabled by current data. From observation points, Ukrainian air force fighter jets that had been deployed to intercept incoming guided weapons flew past – advanced fighter aircraft provided to Ukraine by NATO members.

Moments later, Kyiv's air-defence systems engaged: multiple launches fired to intercept a hostile projectile. This was a modern interception technology at work, probably supplied through allied countries. Every launch creates sudden vibrations, causing tremors. The moment of terror quickly transforms into resigned acknowledgment: perhaps the approaching threat won't hit its mark this time, preventing destruction from ruin and another blackout.

Continuous Dangers

Following this, a large-caliber weapon engaged a aerial vehicle close by, part of a mobile-fire group – almost certainly Western-made equipment. Sadly, the bullets missed the opposing UAV – it maintained course toward its objective.

Periodically, this continued until dawn. Kyiv faced the morning news: seven people killed, devastation and heating outages in multiple buildings as a result of the nocturnal offensive. As always, everyone still maintained normal activities – enduring hostilities. But those entire period demonstrated Ukraine's essential dependence on international aid – a reliance that European nations are evidently unprepared to replace in the near term.

Ineffective Peace Efforts

The comprehensive proposal from Washington generated strong feelings, debate and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and multilateral gatherings.

Every new approach from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They contain the crisis but never actually achieve victory. This pattern will, no doubt, continue.

Strategic Calculations

It is easy to blame particular leaders of repeatedly advocating Kremlin's demands. But that does not seem to be the complete picture. US administration functions according to a assumption familiar among international relations experts: you cannot win at the negotiating table what you have been unable to protect through force. The US administration assumes that it is unfeasible to force Russia to abandon the territory that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while accepting these circumstances, Washington does little to deter Moscow, through words or deeds, from believing that the current condition will not change more in its benefit in the months ahead.

Opposing Positions

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their motivation to sign a deal that does not give them the greatest potential benefit is almost completely absent. There may be numerous efforts to end hostilities, but they will persist as long as Russia's leader remains completely certain in the result.

On the contrary, Kyiv believes that Ukraine can still persist, slowly losing civilians and areas but preventing a entire defensive failure until conditions improve in its favour.

Present Conditions

Objectively, there are no actual prerequisites for a armistice. Now, subjective factors are entering the equation: political desires to mediate resolution and obtain worldwide acknowledgment, and the government's dual difficulties – on one hand, not to distance important partners, and on the other, to mobilize citizens around the national cause against any plan Kyiv finds unsuitable, so that their priority does not move to internal issues. And although their mission will now be much harder after current events, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a mere seven days to terminate the 28 points of the most recent proposal. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, latest revelations, all did their job.

While new initiatives based on previous concepts are approaching, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and demonstrate specific hesitation to alter the situation, if they maintain solidarity and improve their protective measures at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the predictable period, largely rely on ongoing international assistance.
